These Terms apply to all clients and prospects who engage with TLK Intelligence Pty Ltd, including through our website at tlkintelligence.com, our AI systems, and our service agreements. By proceeding with a purchase or using our services, you agree to these Terms.
About TLK Intelligence
TLK Intelligence Pty Ltd (ABN: 16 525 180 164) is an Australian technology company headquartered in Sydney, New South Wales. We design, build, and operate AI revenue systems for Australian businesses.

Services
2.1 What we provide
TLK Intelligence provides AI revenue systems configured for individual businesses, including AI chat interfaces, lead qualification systems, automated onboarding pipelines, and related infrastructure. The scope of services is confirmed in writing at the time of engagement.
2.2 Assumptions
Our services are provided on the basis that:
- You have provided accurate and complete information during the onboarding process.
- Your website supports standard JavaScript embed code.
- You hold the legal authority to enter into an agreement with TLK on behalf of your business.
- All content and information you provide to TLK is lawful and does not infringe any third party rights.
2.3 Exclusions
Unless separately agreed and confirmed in writing, TLK's services do not include website development, design, hosting, copywriting, outbound marketing campaigns, CRM integrations beyond HubSpot (for applicable products), staff training, or custom integrations with third-party platforms.
2.4 Change requests
Minor refinements to your AI system are included in your monthly retainer (up to the hours specified in your product scope). Material changes to the agreed configuration will be quoted separately.
Payment
3.1 Fees
Fees are as set out in your service agreement or product confirmation. All prices are in Australian Dollars (AUD) and inclusive of GST. Current pricing: Alex Launch A$1,499/month · Revenue System A$3,299/month · Custom Revenue Layer from A$5,000/month (POA). A 6-month minimum commitment applies to all products.
3.2 Payment terms
All services are billed monthly in advance. Your invoice is raised when your system launches and is due within 7 days. TLK accepts payment by credit/debit card or Australian bank transfer. All prices are inclusive of GST.
3.3 Late payment
If payment is not received within 14 days of the due date, TLK may suspend your AI system with 48 hours' written notice. Interest may be charged on overdue amounts at 10% per annum calculated daily.
3.4 Cancellation
A minimum 6-month commitment applies from the date your system launches. After the minimum term, either party may cancel with 30 days' written notice. No refunds are issued for the current billing month. Your AI system will be disabled at the end of the notice period.
Intellectual Property
4.1 TLK IP
TLK Intelligence retains all intellectual property rights in its platform, infrastructure, systems, processes, prompt engineering frameworks, and underlying technology. You do not acquire any ownership rights in TLK's technology by engaging our services.
4.2 Your IP
All business information, brand materials, and content you provide to TLK remains your property. TLK uses this information solely to configure and operate your AI system under your engagement.
4.3 Licence
TLK grants you a non-exclusive, non-transferable licence to use your configured AI system for the duration of your engagement. This licence ceases on termination of your engagement.
Confidentiality
Both parties agree to keep confidential all non-public information received from the other party in connection with the engagement, and to use such information only for the purposes of the engagement. This obligation continues for 2 years after the engagement ends. It does not apply to information that is publicly available, independently developed, or required to be disclosed by law.
Privacy and Data
6.1 Privacy Act compliance
TLK Intelligence handles personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. We do not sell client or prospect data to third parties.
6.2 How we use your data
We use information you provide during onboarding to configure and operate your AI system. Conversation data processed by your AI is handled by Anthropic's API and is not stored by TLK by default. Your configuration data is stored on Cloudflare's infrastructure.
6.3 Your responsibilities
You are responsible for ensuring your website's privacy policy adequately discloses the use of AI chat functionality and the processing of visitor data. TLK's AI systems operate on a one-way basis: they receive information from visitors but do not access external systems or databases.
6.4 Third-party providers
TLK uses Anthropic (AI processing), Cloudflare (infrastructure and storage), and Resend (email delivery) to provide its services. Data processed by these providers is subject to their respective terms and privacy policies.
6.5 Data retention
Client configuration data is retained for the duration of the engagement and for 90 days following termination, after which it is deleted.
Limitation of Liability
7.1 Exclusion of consequential loss
To the maximum extent permitted by Australian law, TLK Intelligence is not liable for any indirect, consequential, incidental, or punitive loss or damage, including loss of revenue, profits, or business opportunity.
7.2 Liability cap
TLK's total liability for any claim is limited to the total fees paid in the 3 months immediately preceding the event giving rise to the claim.
7.3 AI accuracy
AI systems may occasionally produce inaccurate or unexpected responses. TLK is not liable for any loss arising from the AI system's responses to your website visitors. You are responsible for monitoring your AI system's performance and notifying TLK of material issues.
7.4 Australian Consumer Law
Nothing in these Terms excludes or limits any right or remedy that cannot be excluded or limited under the Australian Consumer Law.
Termination
Either party may terminate the engagement by providing 30 days' written notice. TLK may terminate immediately if you breach these Terms, fail to pay within 14 days of a payment being overdue, or engage in conduct that TLK reasonably considers harmful to its business or clients. On termination, your AI system will be disabled and your configuration data deleted after 90 days.
Governing Law
These Terms are governed by the laws of New South Wales, Australia. Both parties submit to the exclusive jurisdiction of the courts of New South Wales. These Terms, together with your service agreement and any written scope confirmation, constitute the entire agreement between the parties.
